By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.

2. Service Overview

PublicResourceCompass offers luxurious yacht charter services, including but not limited to:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private events
• Multi-day charters

All services are subject to availability and weather conditions. We reserve the right to modify or discontinue services at any time.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you must:

• Be at least 18 years of age
• Provide valid and complete information
• Pay the necessary deposit as detailed in your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking is only secured once payment is made and our written confirmation is issued. Service may be denied to any individual at our sole discretion.

3.3 Availability

All charters are dependent on the boat availability and favorable weather conditions. We will endeavor to fulfill your requested dates and times as best as we can.

4. Payment Terms

4.1 Pricing

All rates are presented in $ and include taxes unless stated otherwise. Prices are subject to change without prior notice.

4.2 Payment Schedule

• Deposit: 50% of the entire charter cost due at the time of booking
• Balance: Due 48 hours before the charter sets sail
• Other fees (when applicable): Payable after the charter is completed

4.3 Payment Methods

We accept various major credit cards, bank transfers, and certified cheques. All payments are processed utilizing secure, encrypted methods.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• More than 72 hours before departure: Full reimbursement minus transaction fees
• 24-72 hours before departure: 50% refund
• Less than 24 hours before departure: No refund

5.2 Weather Cancellations

Should our captain deem the weather conditions to be unsafe, we will propose to:

• Reschedule your charter to an alternative date at no extra charge
• Issue a complete refund if rescheduling isn't feasible

5.3 Mechanical Issues

If there are mechanical issues with your designated vessel, we will try to arrange a comparable alternative. If this isn't possible, a full refund will be provided.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

• Adhere to all instructions provided by the crew
• Don safety gear as instructed
• Disclose any medical conditions that could impact safety
• Stay within permitted areas of the boat

6.2 Prohibited Items

The following items are not allowed on board:

• Glass containers
• Illegal substances
• Firearms or weapons
• Pets (special exceptions may be granted)

6.3 Conduct

Travelers must behave respectfully. A charter may be terminated prematurely without refund if passenger behavior is unsafe or impinges on the experience of others.

7. Liability and Insurance

7.1 Our Liability

Our liability is restricted to the total amount paid for your charter. We are not accountable for:

• Personal injuries caused by guest negligence
• Theft or harm to personal belongings
• Indirect, subsequent, or punitive loss
• Delays due to the weather or other events outside our purview

7.2 Insurance Coverage

We ensure proper marine insurance that covers our vessels and operational procedures. It is your responsibility to acquire travel and personal insurance.

7.3 Assumption of Risk

By participating in our charter offerings, you recognize that marine activities carry inherent risks, and you accept liability for your safety and health.

8. Modifications and Itinerary Changes

Itinerary, route or schedule adjustments may be necessary due to weather, safety concerns, or operational requirements. We will try to arrange equivalent alternatives when feasible.

9. Force Majeure

We are exempt from culpability for disruptions, annulments, or changes due to events outside our control, including, but not limited to:

• Extreme weather events
• Natural disasters
• Regulatory mandates
• Port shutdowns
• Vehicular malfunctions

10. Privacy and Data Protection

How we handle your personal data complies with our Privacy Policy. By using our services, you consent to the gathering and usage of your information as outlined in our Privacy Policy.

11. Intellectual Property

All materials on our website, such as texts, visuals, logotypes, and images, are safeguarded by copyright and trademark laws. Unauthorized reproduction, distribution, or creation of derivative works is strictly prohibited without our expressed authorization.
